General Election : Protest 2010

Superhero's to bring a bus load of trouble to the Tories!

In anticipation of a Conservative Government being elected this spring there will be a motorised demonstration through the streets of Bristol and London but starting at Oxford on Saturday 10th April 2010 to get the message across that parental responsibilities are being thwarted by our unjust Family Law Court system and the resident parent more often the mother is alienating children from their natural fathers with impunity and the condition known as Parental Alienation Syndrome is recognised by all other the the Law Lords as child abuse!
Parents who have never been put in this position and the media especially the BBC are quick to ridicule demonstrations by Dads and in a recent departure from previous demo's, as shown at Canterbury last Month, we are now being made aware of such protests in advance and everyone should show support, as these are the good caring dads who like me have been through the courts and done all that was expected to the point of financial ruin only to learn court orders with reasonable contact arrangements put in place In the children's best interest can't in fact be enforced if one parent, usually the mother, fails to comply. You can't complain on the one hand about feckless dads who run of and play no part in their child's well being then criticize these guys who have fought tooth and nail to be involved fully with the upbringing of their OWN kids and then take such desperate measure to inform you of their plight!! It would have been so easy for us to have run off also!

How come we are sworn to secrecy whilst others can make millions advertising their divorce in Hello and the like?

Get the low down on Parliament,direct from the basement!

Could Lord Tebbit be a viable Lord Chancellor & Justice Minister to sort out the failing Law Lords?

I believe the culmination of all the demonstrations should result on Collage Green between the House of Lords and the New Supreme Court soon after the general Election and before they all depart on their 12 week summer holiday! This should be based on the same concept as the FAMILY PRESERVATION FESTIVAL 2010 in Washington DC in July and have a hospitality unit with food and information people dressed as judges in wigs and gowns and scenes of kids behind prison bars signifying going into care!

I am also guided by Second Class Citizen from the US with these wise words;
1.) Never accept defeat; they are your children too.
2.) Never be silent. Evil always wins when good men do nothing.
3.) Do you research in this game. Knowledge is power, and words are our ammo and weapons.
4.) We are categorically and without exception non-violent, and we will obey the law. civil disobedience excepted.
5.) We are non-partial and will always operate with calm and steady resolve.
6.) When communicating with other Operators it is OK to be emotional - but never lie.
Our Three Goals:
1.) To be treated fairly in court, with gender neutral laws and no predispositions or presumptions.
2.) Equal unrestricted access to our children from the beginning.
3.) To be able to live happy, productive lives after divorce, without being tracked and treated like criminals.

Farewell Gordon Brown!

The ten year apprenticeship our prudent Chancellor had at the Treasury failed to prepare him for his rise to unelected Prime Minister, (even his labour party colleagues did not have any alternative but to accept this shoe in leader) and the financial tsunami that was about to hit the world markets. Funny though his predecessor seemed to know when to jump ship rat like at the appropriate moment.
We then saw our leader either blunder through the crisis, or firefight at every turn using money he did not have, and will leave future generations to repay for the rest of most of our lifetimes to middle and far eastern banks as these countries emerge as major players on the world stage, even reaching the status of Superpower, I believe, within President Obama's first term of office.
When Brown does finally leave in the Spring he will leave a colossal mess to sort out and unlike America we do not have a PM of 'New Hope' waiting in the wings to rely on but self serving Parliamentarians, such as our non-democratic Walter Mitty character who has taken us on an excursion into an Orwellian State where the phrase 'Soviet Britain' has become part of political speak.
Actor/comedian Rick Tomlinson promoted a Socialist Labour Party at last years Local/Euro elections which in essence is a return to the Labour party most would recognise, but for me the most unforgivable aspect of this misdirected Premier is his lack of appreciation for our service personnel who fight in the world's hell holes to preserve our freedoms and democracy Gordon Brown is willing to hand to Europe in a hand basket, doubtless in the hope of becoming the next European Financial Minister or even the CEO of the IMF!

At a time we need a strong leader to take us out of this 20 year malaise of apathy in politics we have David Cameron, where are the latter day Hestletines or Tebbits to grab the nettle and put the UK back on the map as a credible enterty? As a life long Tory supporter I was dismayed at the fact we had the worst Government in living memory yet our opposition missed every opportunity to seize any ground and even when the Labour Party had lost faith in their own leader where was Cameron when he should have been calling for an early day motion of no confidence? Something most of the Labour party had lost also, and we could have had an election before any more damage was done! There was no outcry when Labour failed to put a candidate up against David Davis ( not unsurprising as we have established Brown doesn't take democracy too seriously!) So what of the future? I am sorry to report it looks like just more of the same with the Tory's windging for the first year in office that it is all Labours fault when clearly it is not, Cameron could have acted sooner.
Some of us had put a lot of faith in Nigel Farage of UKIP as a credible new leader and if his desk thumping style was anything to go by with Churchill appearing on his promotional literature we thought we had found our man. I even suggested in regular debates I had in a West Midland newspaper that if UKIP put out their leaders You Tube performances out as Party Political Broadcasts, I felt most of the weary British electorate would vote for them and a ground swell of opinion in a national newspaper I contribute to also shows many were up for UKIP, but worryingly many were up for the BNP too, so could tactical protest voting end up giving us a hung parliament? Time will tell!
Meanwhile the erstwhile Mr. Farage has vanished into the wilds of Buckinghamshire in the hope of knocking our newly elected speaker off his seat, which I find a strange tactic as the current incumbent of the constituency he shared in Kent, one Ann Widdecombe is due to retire at the next election and surely this would have be an easy transition to him, and with all due respect to the subsequent candidate even if she is a Family Law solicitor!The cynic in me has raised it's head once more and I believe the prospect of UKIP ending up as a major force in the UK Parliament especially at the loss of all those expenses which make the recent M.P's scandal look like pocket change, is too true of our politics of the day, so we have an Anti-European Party happy to travel to Brussels each week on a very lucrative gravy train!(Click on title to see Farage lambaste Brown in Europe, though his Sarkosy performance is my favourite!)

Saturday World Review : South Africa an Inspiration!

With all the resistance you get when facing the Family Law Court system worldwide you kind of get used to it and walk round so you can come at it from a different angle, so recently have Fathers 4 Justice in South Africa who even as recent as these past weeks have had their website maliciously hacked into and wrecked but true to the spirit of these guys they have fought back with what appears to me to be a slick professional and well
equipped new site! (click blog title to view and the National flag in the sidebar there after!) I have long admired the work of F4J S.A as we learn they even advise their Government on human rights issues, how long will it take Obama, Rudd, Harper and probably Cameron to catch up? More importantly they offer a range of help and guidance for those who are going through this night mare, and whilst I have been critical of so called 'Superhero' antics as being counter productive, I have been won over as it is true, this is the only way to capture media attention what we now need to do is educate the public who have not seen inside the Family Court and the corrupt practises they so endow on us! This battle will only be won, in my opinion on a global scale and it is fair to say the good people of F4J in South Africa are certainly fighting their corner for which the rest of the world should take note and salute!

Parental Alienation Syndrome, a comment from Singapore!
When I made my first dubious step into the world of Facebook a few month ago one of my first contacts was with Wee Cheng of Singapore who, in spite of a less then open Government by our standards is able to bring us his;
Parental Alienation in Singapore - Parenting Rights of a Divorced Parent
This group is set up to create awareness of Parental Alienation and the emotional and psychological damage it can cause to targeted parents and children.
My name is Arthur Cheng Wee and I am a divorced father. Though I have joint custody of my son, the Family Court awarded the CARE & CONTROL rights to my ex-spouse, and I have been constantly deprived of being with my son despite having an existing Court Order granting me 8 hours weekly access time.
There was a blatant disregard from my ex-spouse towards the Family Court Order, but alarmingly there was no accountability for the violations.
Such injustice and oppressions have to come to an end, children need the opportunity and freewill to be with both divorced parents.
Parental Rights are God-given, nobody has the right to take that away.
Please watch the YouTube video and give me your support. Thank you and God bless.

Wee Cheng has two slots in my now extensive PAS section of my blog and I look forward to a long association with him and as I have said "I hope some day we can both find peace of mind from this appalling form of child abuse that should be outlawed in favour of a more balanced parenting method! Good on you Wee!!

Lest we forget!
Finally this week I wish to pay tribute to all those brave troops and service personnel fighting for our freedoms and democracy in some of the worlds hell holes. In spite of our lack lustre politicians attitude (something we are not proud of here in the UK) it is heart rendering to know people as young as 18 are returning to their loved ones for burial, now it seems on a weekly basis, in all our allied nations.We should honour our fallen by exercising our democratic rights for free speech and call those who govern us to account when they get things wrong and they do not always have their peoples best interest at heart!
The remembrance Poppy will remain on display on this blog to remind us of our gallant hero's every last one of them!

Judge This!

My second of two mini blogs in the series, which started Solicitors and Barristers....,
now it is the turn of the Judge!

One thing I learned very quickly in this process was the inconsistency between judges, few showed great empathy with the genuine spirit of the law and showed impartiality between parents others were unapologetically biased either way it makes little difference as these courts continue, (in spite of Jack Straws whoop and grunt attempt to open courts last April) to be shrouded in secrecy and the judges claim this will expose sensitive cases involving children to risk! This is total nonsense and a white wash as just like the open criminal courts that are under press and public scrutiny, Family Judges could say Child 'A', Child 'B' or Family 'XYZ' or just put an identification number on a case which the press have to refer too. This they claim is too much additional administration for them, oh dear too much work to protect a child? more like they are covering their own backs and trying to maintain the authority they, in my opinion no longer deserve!

I spent from March to October of 2004 in family court (above) and in spite of all the smoke and mirrors and obstacles they throw at a father, whilst making it plain sailing for the mother, I still reached 20th October 2004 and with a CAFCASS officer ready to make 'adendments' to her previous report and subsequently spending the whole day in the court office with my ex (so much for impartiality once more) I was granted a joint residency order and 50/50 contact and the wily old judge, now retired and a little like Mr Waverly in 'Man from Uncle' said "Right that is my judgement and now I am going to offer some fatherly advice to you both, that is is down to you to make this work" I acknowledged the judges sentiments whilst my ex offered her hallmark stony poker face and in the time it took me to travel home (under 25 miles) I received 50+ text messages telling me all the reasons why it will never work (She only had to send one really, with her name on it, as that was the only reason why!)

Even by the Christmas holidays she was trying to disrupt the contact and by March 2005 we were back in court this time in front of a district judge now an HHJ who looked like she could have been Anne Robinson's twin sister and who decided to reserve that case for her own and systematically unraveled all that was fought for the previous year at a cost of £32,000 to me and I guess the equivalent legal aid for her. I even had this appalling judge's lacky stand in for one sitting who then promptly placed a penal notice on me for not allowing my children to phone their mother whilst in my care, yet it was me who supplied them with mobiles (ordinarily I considered them too young) so they could stay in touch with either parent at alternative times!
The next time I arrived in court my ex's barrister approached my McKenzie friend, the late Ian Mackay (The first guy to speak in the embedded video on my first blog) and asked " Could you ask your client to stop getting his children to phone their mother so often? this is now a cause of annoyance to her!! You could not make it up!

This disruption went on from March 2005 to September 2007 when as you will know by now she has withheld my children from contacting me in any way yet they only live 1/2 a mile down the road and their schools lay between the two homes. I did return to court one final time in August 2008 this time to a more conciliatory judge but even though, I was told I would have to start the process all over again and involve CAFCASS! I asked why can't you simply enforce the order that exists . She said she was unable to do that (Court orders are not worth the paper they are written on as Lord Justice Ward has recognised!) and suggested I went and sought the CAFCASS officers in the court that day and she would return after a recess to offer my findings, I simply walked out of court telling the usher I will not return!

In all this the children never get their say, just a 'snap-shot' account by some erroneous court reporter from CSF or CAFCASS who do not know you from Adam yet are able to assassinate your character at the stroke of a pen . Why can't the judges get reports from the family GP (doctor) or children's schools who have a more intimate knowledge as the schools often have more contact then the parents. (click title)
At the end of the summer holiday's of 2007 my youngest then aged 8 said " I have had such a great time can I see you as often as my older son?" (She had been with holding him on many previous occasions) I said this was how it was always meant to be, but you have to ask your mum, since then she has with held both my sons now 28 months to date !

Parental Alienation Syndrome is child abuse and should be outlawed !!

Solicitors can make a mistake but don't count on being able to do anything about it, the law society that is supposed to regulate mal-practice are a toothless regulator as they have no power to enforce regulations on the lawyers, yet the solicitor can sue the law society if THEY get it wrong! All in all what comes out of all of this industry is the lack of accountability the judge, solicitor, barrister even the social services account to nobody and this leaves a danger that failure is going unregulated and the upshot is disenfranchised families, children wrongly put into irreversible care and our societies continuing to be broken by this 'professional incompetence', I for one will go on making everyone aware of this until those in the position to fix these failing laws, the Law Lords, do something about and NOW!

Swimming Pools and Bus passes!

Another local campaign I would like to see promoted is that, whilst the location I live in comes under the Lee Valley and by implication, has many rivers and tributaries our local council sees fit to reduce the number of swimming polls in the area when there are already too few for the local population to enjoy.Whilst I think there should be an onus on the council to provide such a service to enable all children to at least be able to learn the basics that may one day save their life it is also ironic to me that the Olympics will stage a number of water born activities here just 15 miles from the proposed Olympic village in East London but what chance of local talent
competing all the Olympic committee seem interested in is who is using the their symbol inappropriately like this!
Well Lord Coe We want or swimming pool back and it is a great credit to local campaigner June Crew and rebel Tory counsellor Jim Metcalf (who was dismissed from the council from raising the plight of the swimming poll that should never have been closed!)

Another campaign I am surprised to learn about is the possibility
that pensioners may lose the right of free travel on buses and if
you click on the title of the blog you can sign a petition to stop
such nonsense!

New Zealand : Family Law in the 21st Century!

One of my Facebook 'friends' suggested in all my work I was neglecting to mention New Zealand (along with much of the rest of the world, I guess) and I have to admit he is right. Until now I have childhood memories of NZ Lamb and Anchor butter, at one time I worked for a Lamb importer and detested every minuet of it, can't remember if I was sacked of quit by mutual consent but ho hum!
More recently here in the UK we have been served up some very tempting Holiday advertisements which if cash allowed, I would be on the next Qantas out of here, ready to bungee jump off the next cliff with Jack Osbourne or Motorcycle round the place with Charlie Boorman (The 2 coolest guys on the planet in my view and I should be the 3rd if you can be cool at 51?)

Anyway back to the case in hand and what can be said about New Zealand and I am grateful to my local contacts Amfortas and Julie for offering some pointers;

"Cool topic for your site but it is a big question.

The best I can do is say, "most countries are similar". There are international groups working together for child support. NZ is part of the Hague law (kidnapping) which is universal although not all countries are under it like Fiji (Pacific Island).

Things are pretty much universal on everything yet some country's governments add words or lessen words on laws or make a small changes for their country's culture.

NZ is going for 50% women in position positions and business boards where Spain, Norway and Sweden go for 40%.

I am not sure what Australia is going for!"

So is there an issue with family law in New Zealand ?'Scrap' the CSA caught my eye on this one;
Dunne Dumps on Dads
Filed under: General — Scrap_The_CSA @ 9:38 am
Well, my prediction has come true see full details by clicking on the blog title;

Child support is to get a shake-up in the New Year after revelations eligible parents owe more than $1.7 billion in payment

Have a read of the full text of this article and start planning what ACTION you are committed to make child tax reform an issue that wont go away.

Yes you can blog and write letters to ministers who do nothing to improve your slavery or you can get on the streets and take ACTION.

The matrix of Family Law will only get better when the members of Cabinet, those who decide the law changes, are forced to make positive change by the ACTION of the child tax slaves.

Its a new year and ACTION is coming : That could be stopping traffic on the Wellington Motorway, occupying IRD offices in Wellington, living in a tent city outside Dunnes home……. .If you want change get ready for ACTION.

Regards

Scrap

That reminds me I had a letter from the Advertising Standards Authority this morning and they too will not uphold my complaint of the recent CSA (CMEC) misleading advert so I am with you there Scrap, action is indeed needed!

Then there is this;

Welcome to Fathers of New Zealand

This website has been designed to help you succeed when dealing with the Family Court.

If you need help drafting your affidavits and applications or would like to be shown how to succeed with mediation or in the Family Court then please feel free to email us.

In some cases of help, a donation would be appreciated. Most people who have been involved in the family court process have little good to say about lawyers who typically only work in an adversarial way.

All of the various men’s support groups advocate representing yourself at least in the early stages of separation. As soon as lawyers become involved hostility increases.

Even if the other party has a lawyer you do not need one and can represent yourself.

If you have a protection order served on you go to the how to do it? for page. You will need to act quickly if you have a protection order served on you.

But hold on the answer is here surely;

New Zealand Family Law in the 21st Century is a new, authoritative, highly accessible work covering all aspects of family law in New Zealand.
Judge Inglis QC, now retired from many years on the Family Court Bench, demystifies the working of the Family Court and discusses the remedies and strategies available at the time when separation is first contemplated, usually the crucial time when families most need for Family Court's assistance. This work is far more than a text book.It takes the reader beyond the law as it is expressed in the statutes and the cases. It challenges us to examine our way of thinking about and applying the law. And not only that, it requires us to examine how family law is developing in the first decade of this century. Is it reflecting society’s expectations? Is it developing in the way that society wants? What further reforms are needed? A snip at $170.00 exc. GST. (always money to be made in this industry!)

This is made all the more ironic when you see what is underconstruction under the New Zealand flag in the sidebar (Rolf Harris says things are a little behind round here), but I have enjoyed my brief cyber-visit to this beautiful part of the world,though a little saddened that even here they are not free of the scourge that blights all our societies,an incompetent and unfair Family Law Court System! http://menz.org.nz/

Davey hopes to have a true visit here one day!

Solicitors,Barristers.........................................

One of the most frustrating aspects of my campaign is that I can't get to the newly separated couple (Fathers esp) and warn them not to entre this murky world of the Family Law industry soon enough to prevent them passing through, lemming style, as we all do in an attempt to settle matters for the true best interest of our children* and an attempt to keep normality and stability in the aftermath of separation!
The best interest of the children is the mantra you will hear time and again from this lot but their actions are further from this truth then you may think, why is it in the Lawyers best interest to settle your desired goal when at £200 per hour for a solicitor and £2000 per court appearance what possible incentive is there for these professional fee earners to solve your problem anytime soon? (Please refer to my earlier blog 'Degree Absolute and Bob Berman's $500 Onterio Divorce.com) The simple answer is none and did you notice that your relationship with your ex partner was far more aggravated once these vultures become involved then before and very few advocate mediation again why should they? In fact I have just learned that the firm I used (Illustrated) actually supports a Hospice, which is ironic when you learn the statistics of those committing suicide as a result of the trauma caused by involvement of Family Lawyers, CSA and Social Services not only here in the UK brought to our attention by Simon Anderton on Fathers Day 2008, in Australia 9252 lives have been lost in just the 2 years their Prime Minister Rudd has been in power, and in the US I have learned there is a strong correlation between the increase in suicide by returning service personnel entering the family law court system!
If Solicitors, Barristers and in deed the Judges were truly honorable they would stop an unsuspecting father at their door and say "Don't come in there is nothing here for you!" Until there is a major reform of these laws on a global scale UK, US, Canada and Australia to start with. I would suggest to anyone to boycott solicitors barristers and the whole corrupt process until they truly do begin to serve the children's best interest and to find common ground with parents and not to capitalise on division!

I was so frustrated during the time I was going through the prosess I staged my own one man protest, I called a local radio show got a photo shoot with the local paper and parked my van outside my ex's solicitor's office (Illustrated) with a banner on the front screen. I even had sympathy from the local traffic wardens, they allowed me to park there for 3 hours when it was restricted to just 20 Min's!.......... The only response I received was
"You spelt the word parasites wrong!"
On another occasion I was planned to meet my solicitor and be introduced to the barrister at Grays Inn Road, London (Illustrated). I travelled to Liverpool Street and Bendy-bus (Davey hates public transport) only to be told the appointment was scheduled for their St. Albans Hertfordshire office (a more convenient journey for me) and as they said wait their we will travel down, another hour on the meter for each of them, when I complained I was asked did I think there was a conspiracy? I will let you fill in the blanks with the answer! _ _ _
